Alcohol Consumption Policy and Legal Agreement for Nantucket Whale Inn 

By purchasing or consuming alcoholic beverages at Nantucket Whale Inn, you acknowledge and agree to the following terms and conditions: Alcoholic beverages will only be served to individuals who are 21 years of age or older, in compliance with federal and state laws. Guests must provide valid, government-issued identification upon request to verify their age, and failure to provide acceptable proof of age will result in the refusal of service. Nantucket Whale Innencourages responsible alcohol consumption and reserves the right to refuse service to any individual who, in its sole discretion, appears intoxicated or exhibits disruptive or unsafe behavior. In the event of intoxication or inappropriate conduct, Nantucket Whale Inn may remove the individual(s) from the premises and notify law enforcement if necessary.

Guests acknowledge and accept full personal responsibility for their actions and any consequences resulting from the consumption of alcohol, including, but not limited to, damages, injuries, or accidents caused by their behavior while intoxicated, and Nantucket Whale Inn is not liable for any incidents, damages, injuries, or losses that may occur as a result of alcohol consumption by any guest or their invitees. Guests are strictly prohibited from operating any vehicle, machinery, or engaging in any activity requiring concentration or physical coordination after consuming alcohol, and we encourage guests to arrange for alternative transportation, such as taxis or ridesharing services, though Nantucket Whale Inn is not responsible for providing transportation.

The introduction of outside alcohol on Nantucket Whale Inn premises is strictly prohibited without prior written consent. Violation of this policy may result in the confiscation of such alcohol, immediate removal from the premises, and possible legal action. Guests who have known medical conditions, are pregnant, or are taking medication that may interact with alcohol should refrain from consuming alcoholic beverages, and Nantucket Whale Inn assumes no liability for any adverse health effects or complications that arise due to alcohol consumption by guests with pre-existing conditions or those on medication.

Nantucket Whale Inn shall not be held responsible for any delays, cancellations, or restrictions on the service of alcohol due to unforeseen circumstances, including but not limited to natural disasters, public health emergencies, or government-imposed restrictions. By consuming alcohol on the premises, guests agree to indemnify, defend, and hold harmless Nantucket Whale Inn, its owners, employees, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising from their consumption of alcohol or any incidents related to their conduct while intoxicated.

Alcohol service and consumption at Nantucket Whale Inn are governed by all applicable federal, state, and local laws, and Nantucket Whale Inn reserves the right to enforce these laws, including refusing service, requesting that a guest leave the premises, or contacting law enforcement as necessary. This agreement shall be governed and construed in accordance with the laws of the State of California, and any disputes shall be resolved in the courts of San Mateo County, California.

Nantucket Whale Inn reserves the right to amend or update this alcohol consumption policy at any time without prior notice, with changes taking effect immediately upon being posted on our website or communicated directly to guests. By consuming alcohol at Nantucket Whale Inn, guests waive the right to bring any claims or lawsuits against the Inn or its staff in connection with any damages, injuries, or losses related to alcohol consumption or related incidents.

Lead Paint Disclosure and Legal Statement for Pre-1978 Building 

The property located at 779 Main Street, Half Moon Bay, 94019, California was built prior to 1978 and may contain lead-based paint, which can pose health hazards if not managed properly. Under the Environmental Protection Agency’s (EPA) Lead-Based Paint Disclosure Rule, Nantucket Whale Inn is required to disclose any known information about the presence of lead-based paint or lead-based paint hazards in the property. Lead poisoning is particularly dangerous for young children and pregnant women, potentially causing developmental delays and other health issues. As per federal law, tenants, buyers, and guests must be provided with the EPA-approved pamphlet “Protect Your Family From Lead in Your Home” to understand the risks and safety measures regarding lead-based paint. Nantucket Whale Inn has no knowledge of the presence of lead-based paint or lead-based paint hazards in the property other than being informed that the building was built prior to 1978 and may contain lead-based paint. Any available lead inspection or risk assessment reports will be made accessible upon request. Nantucket Whale Inn is not liable for any health issues arising from the existence of lead-based paint, provided the necessary disclosures have been made and proper precautions taken. Guests and tenants are advised not to disturb painted surfaces and should report any peeling, chipping, or deteriorating paint to management immediately. In the event of renovation, repair, or painting activities, Nantucket Whale Inn will comply with the EPA’s Lead Renovation, Repair, and Painting (RRP) Rule by hiring certified contractors trained in lead-safe work practices. By signing this agreement or proceeding with a rental or purchase, you acknowledge receiving the required information about lead-based paint, including the EPA pamphlet “Protect Your Family From Lead in Your Home”, and are aware of the potential lead-based paint hazards.
